We will take a look at where to identify crypto and wallets through digital investigations, what to do with when you find it and how to manage it, mine it or sell it. David Castleman
Raines Feldman LLP

David A. Castleman is a Partner in Raines Feldman LLP’s New York and Los Angeles offices, working in the Litigation, Bankruptcy, and Fiduciary Representation groups.  Dave focuses primarily on federal equity receiverships in financial matters, as well as complex litigation in state and federal courts.  Dave was recently appointed as Receiver over a $250 million alleged internet-based cash and cryptocurrency-based scheme in a case brought by the CFTC in the Southern District of New York.  Dave also filed an amicus brief on behalf of the National Association of Federal Equity Receivers in the U.S. Court of Appeals for the 6th Circuit, and he represents the court-appointed receiver in the Saddle River and Denari receiverships in the Northern District of California, and the Direct Lending Investments receivership in the Central District of California.

Prior to joining Raines Feldman LLP, Dave served as an Assistant Attorney General in the New York Investor Protection Bureau, where he helped achieve a groundbreaking, complex $714 million global settlement against a major financial institution on behalf of fraud victims, which resulted in equal treatment of the federal and state claims.  Dave also worked on pioneering efforts by the Attorney General to use the Martin Act to hold fossil fuel companies responsible for their contribution to climate change.

Before serving the public, Dave worked at Sullivan & Cromwell LLP in New York for many years, where he represented a major national bank in the resolution of billions of dollars of residential mortgage backed securities (RMBS) repurchase claims arising out of the 2007-08 financial crisis.  In both the Southern District of New York and the New York Supreme Court’s commercial division, Dave represented financial institutions defending contract and fraud claims brought by monoline insurance companies and securities claims brought by insurance companies that purchased RMBS bonds, one case resulting in a complete dismissal of all federal claims. Dave was also in-house counsel to a quantitative hedge fund specializing in high frequency and other trading.

Dave’s pro bono practice at Sullivan & Cromwell included winning a new trial for a convicted felon in a published decision by the U.S. Court of Appeals for the Sixth Circuit, and spearheading a clinic in partnership with Immigration Equality to represent asylum seekers.  He was awarded the Michael A. Cooper Award for Outstanding Pro Bono Service for his efforts.

Dave received his J.D., cum laude, Order of the Coif, from the University of Pennsylvania Law School in 2006, where he served as Executive Editor of the Law Review.  Following law school, he clerked for Judge Deborah Cook on the United States Court of Appeals for the Sixth Circuit.  Dave received his undergraduate degree cum laude in 2001 from Dartmouth College in computer science, and worked for as a database applications engineer for a large Silicon Valley corporation before law school.

 

Michael Cianfrani
Coinbase

A member of the Legal team since early 2018, Michael currently serves as the Senior Program Manager for Litigation at Coinbase. Not a stranger to an accelerated growth environment, Michael enjoys “peeking around corners” and the challenge of building sound and scalable processes to support a business operating in an evolving legal and regulatory landscape.

Shortly after joining Coinbase and in the course of streamlining intake and response for government agency and civil data requests, Michael was introduced to court-appointed receivers and bankruptcy trustees tasked with identifying and handling crypto assets, many of them doing so for the first time. Since then, Michael has worked closely with numerous receivers and trustees, and has helped to facilitate the custody, transfer, liquidation, or distribution of 8-9 figures worth of cryptocurrency by individuals appointed to manage the assets of a defendant or estate.

For nearly 20 years prior to joining Coinbase, Michael worked in-house, in law firms, and as an electronic discovery and trial consultant on a broad range of civil litigation and bankruptcy matters. He currently lives in the San Francisco Bay Area with his wife and son.

 

Stephen O'Malley
J.S. Held LLC

Stephen O’Malley is a Senior Managing Director with over 20 years of experience consulting on technical issues. He has engaged on some of the largest multinational investigations and is a testifying expert in the areas of analysis and restoration of electronic data, electronic discovery best practices, and testing of related computer software. He is an expert eDiscovery practitioner and data analyst. He is based in New York.

 

Geoff Winkler
American Fiduciary Services LLC

Geoff Winkler is a Founding Member and CEO of American Fiduciary Services LLC. Mr. Winkler leads a team of legal and financial industry professionals who specialize in managing complex investigations, forensic accounting, fiduciary and insolvency services, and securities litigation support. He has extensive experience testifying as an expert witness and has served as CFO and COO in dozens of State and Federal District Court receiverships, corporate monitorships, and in other cases as a fiduciary and insolvency expert.
 
Mr. Winkler’s experience includes leadership in large and complex fraud investigations and forensic accounting efforts in numerous industries including manufacturing, financial services, healthcare, capital leases, consumer services and retail sales. One large private fraud investigation involved the misappropriation of funds from dozens of high-profile, high net worth individuals by their investment advisor. Among his numerous regulatory enforcement engagements, Mr. Winkler led a receivership team in an SEC action against a large operator of retirement care facilities in 38 states that was accused of defrauding over 12,000 investors and creditors for over $1.2 billion. The restructuring effort resulted in a sale to Blackstone Group, with most investors receiving interest in addition to their capital investments returned to them. These efforts resulted in winning the 2011 Turnaround Management Association Turnaround of the Year award.
 
Prior to forming AFS, Mr. Winkler was Managing Director with Alvarez & Marsal, the Director of Fraud & Forensic Investigations at Bates Group, a litigation consulting firm, and the Director of Case Management for Grassmueck Group, a fiduciary and insolvency services firm.

 

Hernan Serrano (Moderator)

Hernan Serrano has over 30 years of experience in the bankruptcy, restructuring, and business consulting arena. He has worked as an advisor to law firms, investment banks, accounting firms, numerous privately owned businesses, commercial banks, asset-based lenders, financial advisors, and corporations. His client engagements include business acquisition/sale advisor, creditor rights, fiduciary services (including acting as a monitor, trustee, receiver, and examiner), Chapter 11 transactions, corporate liquidations, corporate reorganizations, corporate finance, and corporate restructuring. He has served as a trustee and receiver in numerous cases, including actions brought by the Federal Trade Commission. He is known for his expertise in assessing situations quickly and running companies productively and efficiently.

Hernan is a Senior Managing Director in the Corporate Finance Practice. Hernan oversees the representation of Creditors’ Committees, Debtors, and other parties in interest to bankruptcy, insolvency, and Out of Court Proceedings. In addition, Hernan has served as receiver for federal agency matters and as a bankruptcy trustee.
